Any replacement unit or repair of the original unit, shall not establish a new warranty period. Components must be installed and operated in accordance with the manufacturers’ recommended procedures and in conformity with applicable FAA/EASA regulations and procedures.
The sole responsibility and liability of Berkley International and your exclusive remedy under this claim arising out of the delivery, or use of the product shall be the repair, replacement or credit for the defective component at Berkley International’s option.
In no event shall Berkley International be liable for any special, consequential, incidental, or penal damages or expenses, including, but not limited to, the cost of removal and replacement of the component, loss of or damage to associated equipment, cost of capital, cost of substitute products, cost of troubleshooting, facilities, or services, down time, or cost of claims of third parties for such damages or expenses.
